There are three defendents still in, as was put, "legal limbo".  Most of 
the defendents stuck it out and were dismissed from the case (none of us 
own pet-related businesses that transact in New York).  One defendent was 
not dismissed because he owns a business that sells plants over the 
Internet and could be construed as competing with the plaintiff.  Another 
was not dismissed with everyone else because of procedural issues, but 
recent documents seem to indicate they are catching up.  One defendent, 
dismissed from the SECOND case, still remains in "legal limbo" on the 
original case.

Neither the first nor the second case has been thrown out in its entirety. 
Both have been re-assigned to a new judge, and she seems to be finally 
getting around to addressing the outstanding motions.

Though I'd always be careful of how I word my criticism of any aquatic 
plant-related business, I would be doubly-so if I actually *owned* an 
aquatic plant-related business.
